I need help in trying to prove my brother is innocent. First of all his exgirlfreind is accusing him of rape. As the investigation goes on they asked her to due a rape kite which came out negative. But right know he is in jail because they are taking her word for it. They where living together so they of course had sex two week priore but so she had hickys but they were old. She clamied it was done the day she clamed she was raped. Second, she reported the rape the day after my brother said he was going to take her to court for custody of their little girl. I know this is her mothers doing. My brothers ex calls us and tells us she is going to drop the charges cuz she feel my brother has suffered enough. Then she gets her pschy evaluation where she does one of her many acts. And passes as a distrube victime. Then she calls us laughing and tells us she changed her mind. We have seen this acts of her for over a year. SHe is pretty good. But my brother has been in jail for two week.

I need help what do I need or due to prove he is innocent. we have attempted to record her. but she is always one step ahead. she even went as far as pressing charges on my mom when my mom called her to record her. she is an illegal immagrent and was told to her by a peace offeser that if she was a victiam of a crime that she could get her vise with out any problems plus she can get wellfare.

We have gone to the police and they wont listen to us. They said that what ever we have to say is not usefull cuz we are related to the accused

every thing IM saying is true. Second she hangs up on us we she called and said she changed her mind after that we called her to record he she hanged up on us and the we were notified that charges were pressed on my mother. Second I have gone to my local news paper and a reporter of their is doing his best to find out what is going on and why the police department arent help answer our question.

If this goes to trial you need other character witnesses who can testify that she did this to get revenge, and your brother needs witnesses that put him somewhere else at the time she claims. See if you can get a record of your incoming calls so that you can prove that she is calling the house and harrassing your family.

HELLO!!!!!! If you are telling the true (which I doubt), put a recorder on the phone (she does not have to know there is a recorder on phone) and record everything she says. Also keep copies of your phone records (you might have to get a upgrade from the phone company for this, pay extra), you will need more than just her voice on recorder, her phone number on records should do. Take everything to the DA and tell them you want her prosecuted for wrongful allegations, (keep a copy for yourself), If DA does not want to do any about it (usually cus it will make them look bad), go to your local news (as many as you can) and show them your proof, they love this kinda of stuff.

Just so you know, in some states not only is recording someone without their knowledge not admissible in court, but it can also get you in trouble. I'd suggest finding that out first before trying it out.

Pray he gets out of this without going to jail. But your bother is going to have to learn how to pick his women more carefully from now on, and this should be a good sign for him to know that he needs to use better judgment.
