my stepmom hit a drunk man that ran across the street he got up and cussed but him and his friend eventually walked away

i think she should report it because tommorow he might decide he wants to tell and say she hit and run

Yes she should. Plus, he wouldn't be drunk anymore when he reports it and it would be her word against his.

The part about him being drunk is of course an assumption I guess. He was hit and he got back up and had enough presence of mind to cuss, so he probably 'felt' or sensed something as result of the collision. It's a judgment call on your stepmom's part. I'll give her something more to worry about (sorry...it 's just something you need to factor into all this). Your stepmom was (maybe) alone in her car when the accident happened. She hit a man who was with a friend (aka: witness for the man that was hit). Mom + no witness against Man + witness = ?? Evidence: No proof of intoxication. No legal justification to leave scene of collision.

Just ignore me. I always think of worst case scenarios.

Really though, there's only so much you can do when recommending a proper course for someone else to take. The whole thing has a long term benefit to you however, because you sound like you have a more sensible way of looking at these things, hence your driving career (and other aspects of your life) is likely to be filled with the rewards of good judgment.

He was public intoxicated he won't report it. he's probably still drunk.
