I have a feedback score of 100% and have just brought a dustbuster that states in item description that it is in 100% working order. Its not. It wont even charge up! The seller hasn't left my feedback yet and wont respond to me at all (3 days now) should I leave a neg and risk getting one in return or not?? what would you do?

First, place an item dispute - go to 'dispute panel', and state that the item is not in 100% working order, as stated in the seller's description.
If he answers dispute, and says he will replace, then ok, wait for replacement.
If no answer to dispute, close dispute, claim your money back via Pay Pal, and then
LEAVE A NEGATIVE...Ebay doesn't count negatives left if the seller doesn't reply to the dispute, so that protects you. If he does leave a negative - Ebay puts a note where the feedback is listed in your profile, and states the buyer did not respond to dispute..then you can also put a reply to his negative (which still shows but does not count)..stating something like "Item was faulty and seller would not respond to my emails".
I wouldn't take any notice of a single negative (not counted in your total) from a seller that obviously was in the wrong!

If you paid with PayPal you can file a dispute with them stating that the item received was not as described, and you can usually get your money back that way. If you paid by another method it's a little harder, but you should still be able to file a complaint through eBay. I would hold off on leaving any feedback for now until you get your money back or reach some sort of resolution, otherwise the sellers tend to get bitter about the negative feedback and become less likely to work with you, as well as leaving negative feedback in return.

Wait longer 3 days is not enough time. That's a long weekend.
If nothing happens then make a dispute with paypal - hopefully that's how you paid. And they will make an effort to contact the seller.
If that fails then leave the neg and get your money back from paypal protection.
Leaving a negative too fast will only make the seller not want to help you, assuming that they didn't do it intentionally

That seller could have knowingly sent you crap. The only help you'll get from eBay is an opportunity to present written evidence from a qualified person that the vacuum is indeed defective. If eBay decides to accept the evidence, you must return the item to the seller at your expense in exchange for a refund of the bid price only.

A criminal has nothing to lose on eBay. They can send you garbage and you will pay to ship it both ways and jump through all kinds of hoops to get any refund at all. Many people won't bother with the process. eBay makes ALOT of money on this fraud. A seller can be reported for MANY fraudulent transactions and still be allowed to sell on eBay. eBay KNOWINGLY makes money on criminal transactions. eBay crime continues to grow. THE CRIMINALS HAVE NOTHING TO LOSE BY eBAY'S "RULES".

My advice... eBay isn't what it once was... Kick the habit. Criminals are getting your money.

If you MUST buy something on eBay... ALWAYS pay by PayPal using a credit card issued by a company that will reverse PayPal charges at your request (some won't... ask). Anyone sells you garbage... Reverse the charges... Tell them you'll send their garbage back after they send you the money for shipping it... both ways.

Contact eBay. It is against contract if it broke and they say in working order. Usually there is a 7 day return. They have a live chat thing to ask question from someone who works for eBay.

Because Ebay is a place that loosers like to hang out (people that will retaliate with negative feedback if you leave it for them), I would say your best bet is to contact ebay, safe harbor and paypal. (If you paid via paypal). Hopefully, you did use paypal as they are more likely to get the $$ back for you. Hope that helps!

Hell yes. Even the best of the best Ebayers have some negative feedback. YOu can't please all of the people all of the time. If you bought it with paypal you may have some recourse with the seller and getting your money back as he won't communicate with you.

Yes I would definately leave a negative with the details "Item not working.No response from seller.Poor Ebayer".

3 days is not long enough to wait for a response...some people go offline for that long....wait at least one weak and keep emailing them...then report them to ebay....If they do give you a negative...most people are sensible enough to see that you are not to blame and it is retaliatory negative.
