You can be offered a settlement anytime, even while the trial is going on. That's so they can cut their losses!

Most insurance companies try and get you to sign a settlement before you get a lawyer!!

The lawsuit is going to be expensive, no matter who wins. For many insurance companies, upon review of the facts they decide it's cheaper to settle then to fight the suit, even if they end up winning in the end.
