Friend's wife (they've been separated a LONG time) both have lived in Florida. She has disappeared with his very young son and we believe she left the state probably. Any chance she can be held for kidnapping or anything? How can he get to his son again? They are very close. This will destroy this little boy too. No divorce proceedings right now or child custody - child born and raised right here. She took him once before but only 2 hours away. This time we think she's gone-gone. What rights does he have? How can he find him?

He needs to at least file 2 missing people reports with the police. He also needs to call a lawyer immediately and see what he has regarding rights. If there were no custody decisions before this, it may prove difficult to do much other than try and get the missing located. However, he does have rights to see his child, and the courts can help there. Unless they can prove she is unfit or has the child endangered, they will not take custody from her completely. Good luck to your friend and his search. He may also wish to hire a private detective to help locate his child.

The first step is file a police report, let the local police department tell you what your rights are, they will start a search for missing persons or kidnapping, whichever they find appropriate. Until the mother and child are found, there is nothing legally the father can do except consult with a good family lawyer. Good luck to him.

He needs to get a lawyer and get temp custody till a court date can be set. Once thats done, she can be charged with parential kidnapping. Untill a Judge sets custody though, nothing can be done.

HINT get a private det. to look for her, they can track by SSN and other ways he would not be able to. Then, he can go there and take the boy and get back to FL. Since no custody order has been filed, she cannot charge him with kidnapping.

He should call the police immediately. He has full parental rights. He may need to consult an attorney.

I believe FL has an Amber Alert Law - he should be contacting the local authorities.

Call legal aid in Florida she is breaking the law.

If she is the biological mother there isn't much he can do. He
needs to contact an attorney and be able to prove she is a
threat to the child. If she isn't then I doubt there is much he can do.

file for a missing child report ~ file a police report and go to the couny court house, they'll take it from there !
