My friend at work has just returned back after 5months long term sick....What are her rights about returning to the position that she had before....Some guy is doing her job now and all that poor girl is doing is packing....I feel sorry for her but she does not like to just kick him out of his chair..anyone know her rights..We do have a manager and she said for the 1st couple of days just get back into it....but she has been back 2 weeks now...but yet they expect her to cover when he his on breaks....any ideas..

If you have Union in your work place talk to them, or go to HR and speak to the Manager, this is not right, it really depends how long she has been at the company. But to tell you the truth she should stand up for herself, and if her manager is a woman well they are the last ones to actually care, but yes your friend should put her foot down ask what the hell is going on. unless the company has officially said to her that she cannot have her original position back after 5 months then she can go straight back to where she came from when she left for long term sick, maybe with a little bit of training, but she needs to sort this out herself

she should be back in her own seat doing her work as before she was poorly, the manager should of sorted this out before she returned to work.
she will have to have a chat with the manager im afraid only way to solve the problem.

She probably really has no rights. Even if only FMLA, family medical leave, she would have a right to A JOB up to 12 weeks off.

the first thing she must do is join a union , then ask for a one to one with her line manager and tell him she wants her job back , then if they do not comply , i suggest she has a good case for constructive dismisal

Its obvious management don't want her back. She needs to find another job.
