I have not taken possession of my vehicle and it is still at the shop. I KNOW that there was no damage to my vehicle other than what was sustained in a minor accident. I believe that the body shop had further damaged my car while fixing it. My deductible is $500 and my insurance company has already released the funds to the shop for the work finished PRIOR to me taking possession of my vehicle. The body shop will not release my vehicle until I pay the deductible. Which is fine with me since I won't take possession of a car that has not been fixed properly. What should I do?

Notify your insurance company. See if they will get involved.

Easy- tell them that you are not happy. Call the insurance company and have an adjuster examine the work done and the new damage, it up to them to fix all of the damage. Plus tell them you will call the Better Business people.

Really makes you mad don't it??? Welcome to the world of body shops. that's why I hate to hear someone drive recklessly then say "no problem, it's insured". Nothing makes up for the anguish you are going thru right now.

Go talk to your insurance agent or adjustor right away. But eventually, after returning my car 2, 3, or 4 times to get stuff fixed that they caused while it was in the shop, I just got tired and cut my losses.

Contact your state consumer affairs office to be referred to the department that handles auto repair. (in California, that department is the Bureau of Automotive Repair.) The department can assist you in mediating with the body shop to make sure all parties are satisfied.

If it's such a small dent and scratch then ask them to fix it for you..... the money the insurance co gave them is probably more than they charge a regular customer anyways..... so they shouldn't be to upset by it....

You NEED to call and explain it to your insurance company and see what they'll tell you to do. I would also talk to the shop owner or manage and get their thoughts.

There should have been a check in sheet when your car had arrived at the bodyshop-they should have shown you and had you sign a copy of the report-ask them where it is.

Tell them to fix it. More likely you missed it because they are small and you were not looking closely before.

Be careful.. Thry will start to charge you storage fees.

If they wont fix it pay it 'under protest' and sue themin small claims court.
