it running right outside my window.

We have been estrainged for 3 yrs. He said he doesn't love me, but he won't leave. He says he can't find a place to rent.

I told him we can't file for divorce until we have been separated 6mos so I don't care where you go or what you do, just go. I took all his stuff out and it is sitting in the living room floor.

I don't know how to make it more clear. Now what?

U give him a 30 day eviction notice and put up no trespassing signs in ur yard.. after the legal notice is up if he comes back u can call the cops and they will remove him..

Depending upon what state you live in and unless the house is solely in your name... he doesn't have to leave, just because you asked him to. Unless there are police reports of spousal abuse, no judge is going to grant you a restraining order.

Your best course of action is to get a lawyer. I know of some states that after 6 months of separation you can file for divorce or you can start the procedure and THEN separate for the 6 months... but he has to agree to all of this.

I'm afraid you just can't ask him to leave, throw all of his belongings out, change the locks and that's it... he can easily go to the police and if there is no court or restraining order, they will direct you to let him back in. Remember, you're still legally married, so what's yours is his and what's his is yours.

Get an attorney... I believe they may be able to use the fact that he left (abandonment) in the first place.

Call the police and get a restraing order. Where do you live that you cant file for a divorce for 6 monthes> I know theres a waiting period after you file but I never heard of this one. what hes doing is harassmentand cou;d turn ugly You dont want to end up like that movie war of the roses!

For one thing you quit moving his stuff too soon. It should have gone to the curb. No place that I know about has a rule about not filing for divorce until you've been separated for 6 months. FILE!!!
PS. Why even think about accepting his excuses about not being able to find a place to rent?

He is allowed to park his semi right outside your window and leave it running? Your neighbors didn't mind? Get rid of this looser. call the cops. I've never heard that you have to be separated for 6 months before you get a divorce.

Get a restraining order to keep him 500 yards away. That way you won't be bothered by the sound of his truck running at night. Tell him to rent a storage space to keep his belongings in.

Remove his things from the house and set them outside. Him not being able to find another place to stay is his problem, not yours. Hire an attorney. That attorney will make many things clear to him.

Move on with your life, he's out of the house at least and he's in his semi so shouldn't be any problem. Just keep him out and don't talk to him. Put his stuff outside instead of leaving it in the livingroom.

Right now go and call the cops , you have every right to be happy and should lead your own life . Stop it by using law of the land , make complaint now or never
