Inherited a home, and have to split it with sibiling. Is probate court necessary? There was not a will. There is no one arguing about the house. All matters are settled, and we will buy out the other half of the house.

Depends upon the law in your state, but in California probate is a requirement for all estates - it's just that smart people don't leave much of one, having planned for their eventual departure by fixing their assets so they are not subject to probate. Check with a probate lawyer in your state, but most likely 1) Probate is mandatory, 2) You can do it yourself, but it's likely to take longer, cost more, and you're likely to make bad mistakes, 3) five to seven percent of the value of the estate, per year, is the figure I keep hearing from the attorneys I know who handle this.

Probate takes a minimum of nine months, during which time you will have only provisional access, via approval of the court, to any assets.

Oh, and by the way, it's *NEVER* settled until the probate judge says it as.

My mother has been deceased almost 9 years do I still need a lawyer?

Not enough facts but I reckon you need to go through a lawyer nonetheless.... Might not cost you too much since it seems straight forward....
