What is the consequence for the drunk driver?

Drunk driving, but they have to prove the heart attack killed the man and not the car.

The driver would get a DUI. They would have to prove that the heart attack was BEFORE the man getting ran over. If the heart attack happened at the same time the man got ran over, it could look like the driver may have caused the heart attack & was hit while having the attack.

Hopefully the driver pulled over & stayed with the man until help arrived. If not, they could also be facing a "leaving the scene of a crime" charge.

This actually happened to my uncle.. Well the guy died on the side of the road and my uncle while drunk driving ran over the body and originally he was arrested for murder until they realized the guy had already passed away before being hit by the car. My uncle still ended up with a DUI charge...

He would get a DUI but I doubt he would be charged with vehicular manslaughter. An autopsy should prove that the cause of death was the other guys heart and not the impact of the car. If there is a significant amount of time between the heart attack and the car impact then it becomes even more clear cut.

Was there anyone there to hear it? Did it make a sound? The drunk driver may not be charged with anything relating to the death of the person, but hopefully it will leave a mark on him and he will change his ways, whether he gets in trouble with the law or not.

That's like saying if a mouse eats rat poison and a cat eats the mouse before he dies and the cat dies who killed who? Actually the guy that died of a heart attack would be found out at the autopsy and the driver would freak out and have a heart attack and die too.

You cannot kill someone who is already dead. Forensics would prove whether they were dead before being run over.

You would be guilty of drunk driving but it would also be exascerbated by the fact you had run over a body in the road that could have been a live person.
