my mother just recently passed away and the family member who helped with the funeral is commiting fraud to get the rest of her insurance money from other policies of which I am the beneficiary. I have been told that I no longer am the beneficiary how does that work I am her only child. i need immediate help what should I do

Contact the lawyer who officiated her will, and then perhaps get your own lawyer. Good luck

Contact the insurance companies and ask if your are the beneficiary on the policies. Just because you are the only child does not make it impossible that your mother named someone else on a policy (like a sibling or a parent).

If you are the beneficiary, notified the insurance company that you are alive and well. Then contact an attorney to get help in settling this matter.

If you were the beneficiary of these policies before she dies, they CANNOT be changed after death. The only person that can make a claim for this money is the beneficiary, and if that is you, you have nothing to worry about. You need to call the ins. company to find out for sure who is listed as the beneficiary. If you are, they will send you claim forms to fill out, you will sign them and send them a death certificate and then they will mail you a check.

Hello Karen,let me start by saying i have no law experience however it would seem to me you being the only child and assuming your father is no longer around,you would indeed be the soul heir of your mothers estate,[my condolences]if she did in fact make you the beneficiary and not some other family member as guardian of yourself until you reach legal age in which she left you her financial assets set up in a trust fund ,[sorry,assuming you are a minor].Either way it is imperative to seek a REPUTABLE probate lawyer. I"ve seen what money can do to the closest of families.Beware and the absolute best of luck. GET A LAWYER.

Only your mother while living could have changed the beneficiary so if she didn't do that, your ok. But you do need to talk to a lawyer, get the facts from him, and then tell that family member to go *%@# off!

So sorry to hear about your mom, but contact a lawyer and explain the story to him or the same way u did to us and he will see if criminl charges needs to brough againt this family member. Also try to get closer to your family don't let this 1 bad apple deter you from being with the ones you love. Also how did she get information about your mom's insurance policies. Also contact the insurance company to see if any money has been paid to the family member and if not warn them that she's out and lurking for a way to get the money so be willing to become a snitch for a minute to make your mama smile and show her how strong you really is.

You need to get a copy of her policy. You should be able to talk to the insurance company. They might not tell you much unless you have been to court and have a copy of the letters testamentary appointing you executrix of the estate, but they should have the information of who the policy belongs to. They will only pay to the beneficiary or to the estate. You might end up needing a lawyer.

I am sorry for your loss. I would contact the insurance agencies right away and let them know your feelings or the potential fraud Also, you will find out if you are still the beneficiary. They will let you know.

You could also contact your mother attorney or your own they can help you too.

Are you SURE you were the beneficiary? You do not have to be next of kin to be a beneficiary. If no other beneficiary is named, it will default to next of kin. Different states have different laws around this. You really should get a lawyer. You can probably find one who will take this case pro bono.

Talk to a lawyer. No one can remove you as beneficiary except your mother. Sue the hell out of that person.

Get a lawyer. I just went through this. People get so nasty when someone dies. I'm sorry for your loss. I just lost my Dad at the end of May. He left his life insurance to his ex-wife/girlfriend and I am the one who had to pay to bury him.Good Luck to you.
