In Texas, if you don't respond to a lawsuit or divorce petition, you "default" and the other party wins "by default". Again, in Texas, the person who filed would get 100 percent of the marital assets and, almost certainly, custody of any minor children.

You'll need to check the laws of your state. They are probably similar.

If they dont respond to Your petition and the 30 days have completely gone by with no response to you then that means you have won! Contact your courthouse and find out how many days he has left to respond just to make sure and ask them what you need to do if he doesnt respond and go from there.
