I have raised him since he was 5 month old. He is now 20 months old. I am going through a visitation issue with my ex wife for my daughter. She will try to have my son taken away by saying I may harm the child. I am 50% rating by the VA and I am seeing a councelor every 3 months and I take medication to control my dreams. Could the state of AZ take away my son? Is there a website I could research this on?

My son is with my current wife, not my ex. I only have my daughter with her. My wife is in Ft Pollk, LA and I descided to stay here to see my daughter. Again, my son is NOT from my ex wife.

Not solely for the ptsd. If you can get a doctor to write a letter/testify that you are not a danger to your son, then I really don't think they will remove him from your care. A medical professional will go further than your ex stating that you are a danger. They will take into account how old your son is, and what is really in his best interest. Just her word will not be enough to remove a child from your custody.

You are not telling us everything, I suspect. If you are having serious problems with ptsd, seeing a counsellor every 3 months is not good enough. The VA is notoriously inadequate. You have to rattle some cages to get the help you need.

Does the medication help with your dreams? How do you know? Has someone besides your son observed your behavior with him when you are under stress or dreaming?

There is no website for these issues, at least not one accessible to non-medical and non-legal persons. You may find some info on vets blogs or ptsd blogs, but it will be very uneven.

What are your son's symptoms that your ex is raising these issues?

It doesn't matter that you've been diagnosed with ptsd. If Child Protective Services is convinced that you are a danger to your child, then, yes...the state may choose to remove your son from your custody, regardless of what you've been diagnosed with.

My suggestion for you is to IMMEDIATELY contact a lawyer who specializes in family law and explain the situation to him/her. If your ex is really going to try to assert custody over your son, then it sounds like it's about to get nasty. As such, you're going to need someone in your corner who can help you navigate the complicated custody system and be an advocate for you....

I would think that if you have the counselor or doctor testify that you don't pose a problem to your child and that you are going to counseling and taking your meds, you should be able to continue with visitation. Talk with a lawyer about what you need to do in order to show that you are fit as a parent and capable of maintaining your visitation with your child. Good Luck!!
