Assuming a state where the legal age is 18, the only way it would be legal is for them to be married. Then she would legally be emancipated and can have sex with him. Each state has different laws about what has to be done to marry a minor, usually parental consent and a court order is necessary.

The parents have to concent for the minor. If they don't, they can press statitory rape charges against the 18 year old.

If the sexual act is illegal in your state, it is illegal to travel to another state and try to take advantage of their laws.

Once you return to your state, your boyfriend could still be found guilty of rape.
