The nonpresent parent hasn't seen our children since March 2000. Children are now teens and would like to give up that part of their life and take my spouses last name.

Is there an AGE when/where they can decide with the nonpresent parents permission?

talk to a lawyer. i believe the non-custodial parent can be asked to sign away his/her rights. then your spouse can adopt them. but a lawyer should be able to tell you more

The other parent needs to sign away his rights. Only then can your spouse adopt them.

That's possible?? o_O I thought the primary custodian of the children had the right to do that...
