Going to war, fighting in a war, without being a "official" soldier? Freelance so to speak. What's to stop someone (legally) from going to war without joining the military?

Awesome answer Dallas M! The story behind your answer is great. But still, NO one has answered yes or no that could prove it legally. JoeSchmoe gave a good answer but, his was based off of assumption not evidence. I need it to be proven legally.

Absolutely not. In fact the US hires many Mercenaries to do some of the more dirty and deniable work for them.

My granddad was one for the US in WWII. He made a lot more money than the typical soldier, but then again, he was a bad mother______.

Me, I'm a pansy.

Without the protections offered by being a regular part of a recognized military force, the person would potentially be liable for criminal charges based on their conduct.

it's a violation of the laws of war. if you are not part of an official fighting force, you are not entitled to the protections of the Geneva Conventions, as you would be an unlawful combatant.

Under the Conventions, if I remember correctly, to be a lawful combatant, you have to be in uniform and be a member of a recognized fighting force.

Absent Geneva's protections, if captured in a war zone, you could simply be executed, if the law of the country in which you were captured permitted that.

War is the only time you can kill someone without getting charged. If you decide to freelance you will go straight to jail and you will not collect your $200.

The Geneva Convention goes into a lot of detail on this - who is considered a member of a military force, what rights they have, etc.

Mercenaries are ex military
If you wanted a security job in Iraq they want mercenaries as guards. Can engage only if fired upon.

Yes it is. A soldier in the military is representing his/her country. If you are a "private soldier" (freelance), who do you represent? It would be much like pirates are.

They are called mercenaries. They are paid by an army to fight
Sometimes they will fight on one side for a time, then switch sides and fight for the other side
