Under Ny state laws you have meet one of 3 criteria to become emamcipated. There is no process to go through, but you can get a letter saying you meet the criteria from youth organization. An 1 of them is to be residing somewhere else, paying rent, etc. So does that mean if I just leave my house, to reside somewhere else, and my mom tries to get me back home with the cops. That it wouldnt work because I am fit under the emancipation criteria. I am 16 yrs, and i have given this deep thought? Will she be able to put the pins out? What can she does if i leave? Answer asap! plz

If you are legally emancipated there is nothing you can do except break her heart.

To be emancipated you just can't leave home at 16, you need the court to declare you emancipated! Some states, like mine, have no emancipation!

What she can do is put out a Missing Person's, and if you are staying with adults, they can be charged with the felony of Harboring a Minor! When you are picked up you will be a CHIN's and most likely placed in a group home!

If you are having problems at home, seek some outside support! If something is happening to you at home, seek some outside support.

Listen, dropping out of school to take a minimum wage job so you can live in a dump is not a way to begin life! These days you need a master's degree!

Your answer is not running away because someone makes you feel good, or you don't have to listen to your parents! Neither will last forever. What you decide now will!

Stay calm, friend. It would be wise for you to go to a local library and research government and social service agencies that can talk to you about more options. I suspect, based on what you've written, that you may be mistreated in your mother's home. Stay calm, and research places in your area (within 300 miles maybe) where "troubled teens" are given shelter in a youth home. Perhaps the shelter could be your new "legal" address? Sadly, often the system has nowhere for a person to go when he or she is mistreated at home. There has to be a whole case of abuse or neglect filed by Child Services or DYFS, etc. But stay calm. Pray. Go to various churches and religious institutions asking for advice. It is truly amazing what kinds of things become possible when you just ask people.
Anyway, tell the authorities that you're being mistreated if you are, and tell them that you adamantly refuse to spend a single day in your mother's house (if you're mistreated there). Stay safe. God bless.

I don't think you can do that.

It looks like living apart isn't enough. You have to be "beyond the custody and control" pf your parents. You also need their permission to work, drive and get routine health care.

what can she *do* if you leave....oh, and to answer your question, she can go above the law and hire some criminal thugs to tie you up in some shack on a lonely island in barbados...of course, it all depends on how rich your mom is
