My daughter knows her dad had an affair with a woman whom he know lives with and my daughter refuses to spend time with him if his girlfriend is around. The woman used to call our home and if my little girl picked up she would curse at her.. She want's nothing to do with this woman. But I am being told that she still has to go with her dad because of the court order. What do I do?

Really, it would depend on her age, unless there is or has been some type of abuse at her dad's house. I know in Oklahoma, kids as young as 10 have been allowed by the courts to choose whether they want to spend time with a parent. I would seriously discuss the cussing problem the dad's girlfriend has with him. If he is not willing to put a stop to that, I would suggest taking him back to family court to discuss the issues with a judge. Depending on your child's age, the judge will let her speak.

The least her dad could do is to not have the other woman around, but depending on how old your child is, she has the right to say whether or not she wants to spend time with him, and the judge will listen to her....you should contact your lawyer...

have her talk to her dad on the phone first. In privet so she can tell him how it is. mybe he will make sure his new girl is not there and if your daughter still dosent want to go. have her go, when she get there she needs to slap her self in the face then call the cops say he hit her. i dont know? but she has to talk to him and tell him how he fells but talk it over with a lawyer so you dont get in to truble for not going. but a daughter needs a dad do what you can to help the situation.

Get a hold of child services in your state and explain. They will want to speak to your daughter alone about this.

Everything you said needs to be true or it will back fire on you.

The choice is contempt of court on one hand and the visit on the other. Take your choice.

Talk to the dad and talk to your attorney. Maybe you can get it changed.
