If you took too many paid days off without earning them then yes he can. But if you weren't paid for the days you took off then no he can't. If he insists, speak w/ his boss and go up the chain of command to corporate if need be. Also threaten to get the local news team to do a segment (like I have "7 on Your Side" in Austin, Tx). They love doing articles like that. Bad publicity and I'm sure your boss wants to stay out of the limelight.

He can withhold this money only if he can provide documentation of why the company is entitled to it. For instance, you are possession of company equipment and he will relinquish the check only if you turn over the equipment. I'm not sure I understand the reason you supply for the withholding. You requested days off, and you were not compensated for the time you were not at work? I don't think this sounds like a valid reason for withholding the final check. If they had distributed in advance funds for paid vacation days, and you failed to fulfill all eligibility requirements for the paid time off, then they would have valid reason to withhold your final check as reimbursement for payment received by you that you were not elgibile for.

NO GENERALLY SPEAKING and here is why:

1/ If where you live has equitable laws, a worker will not be denied his wages.
2/ You take time off with no pay from employer. You did not take pay from employer for said time off, hence there is no charge for him to recoup.
3/ An accounting of all monies owed you should be required by your legal jurisdiction.
4/ Most legal jurisdicsion have a court, ministry or dept concerned with the wages of workers. Go there and lodge a complaint of NON-Payment against this employer.
If your jurisdiction has equitable laws, it will leans its weight and authority against this employer, and if it finds your case has merit with either lodge charges against him and/or require him to pay.
5/ TAKE ACTION IMMEDIATELY - not acting is your enemy !!

Document your claim in writing and with statements from witnesses if possible.

I believe this is against the law - but it depends on your state - it is against the law in my state - does he have any proof of what he is claiming?
If you took the time off with no pay HOW can you owe him for this time?!@

he has to provide you with a detailed pay slip showing the deductions. He cannot take pay away for time you actually worked. Contact the Wage and Hours board in your state.

Check in with your local labor board regarding money being withheld. An uncle of my hubby's was just recently awaiting a settlement due to wages withheld- but that was in CA..

File a complaint with the board of labor.

The BBB has nothing to do with wage and labor laws. And they don't pay for lawsuits either.

no they cannot keep your last check if my memory serves me correctly they have 72 hours to get your check to you if they fire you from the job... call an attorney they will give you free advice..

Probably illegal. Check with your state labor department. That helped me collect vacation pay that was due me when I was terminated several years ago.
