No, that scenario would not work. Your modem actually MODulates and DEModulates analog signal to a digital signalor or vice versa, depending on the direction of traffic. Telco lines which supply your phone modem are limited to 56K. In reality, you max at 53K due to telco overhead. But to make a long story short. Your modem will only accept the max speed of 56K, after that everything else will wait its turn.You can not put 10 pounds of stuff in a 5 pound bag

Assuming he could in fact identify the IP address that you are using at a particular time, he could flood you with data faster than your connection can handle. No actual harm to the modem and just logging out and back on will give you a different IP address. He will then have to discover the IP again.

All, it would do... is simply slow it down, or make it cancel his packet that he sends, or it would boot you off until you reconnect. Your modem would live.
