My tenant (who was also my friend) paid his rent of $1200 by a personal cheque. For some reason, I didnt cash it for 40 days, now when I deposited the cheque it bounced back saying that the cheque is cancelled.
At the same time, my friend has also vacated my apartment 10 days back and left somewhere and has so far not informed me of his new residence. He is not answering my calls either.
I want to go to the small claims court for the cheque fraud but I dont know his latest address to summon him to the court. I didnt have any formal lease aggrement with him, so I dont know his ssn either. Also he has not proivided any forwarding address to USPS.
Can I ask his Bank to give me his latest address or ssn? please advice how to proceed further.

Turn it over to the District Attorney.

he best thing to do is call a lawyer! and go to the district attorney because what he did is fraud . the bank will not tell you any information about the person. why did you wait so long to deposit the check? you should try going to this person's work or contacting his parents or other relatives to see if they know where he is . also next time (if there is a next time) make a lease and get a deposit also if he gave a deposit keep it! good luck

Send a letter to his last known address and request that it be forwarded. Ask for certified funds.

If he doesn't respond, get a lawyer to do a postal inquiry for you. It should cost about $25 to $50. A lawyer can request a copy of the change of address form that was submitted for service of process in order for you to sue him. Then file in small claims court.

Or you could go directly to the police and press charges. They will find him for you.

The bank will not give you his information. That would go agains the new customer privacy act. SInce you took so long to cash it he could have put a stop payment on it thinking it was lost or something. Looks like you might be screwed on this one.

u got screwed over so he was probably planning to do it. if u dont have nething written it is hard to get justice. try finding his first and last name online or google his #. or u can go to the police and file a police report
