Court stipulation-I stay on partial rate except for periods of temp. total disability due to surgery.I have now been totally disabled 3-4yrs. Lawyer said"this isn't binding,we can get out if need be"but sure seems to be now!...Been on 15yrs.-$102per week,;need total rate! Court date for the raise in rate was 6/21/01.My lawyer is no longer in the Firm that rep'd me and they ignore my pleas for help-am I screwed for life? Believe me, I need HELP!

You should have a complete copy of all court proceedings. If you don't have a copy you can either ask your lawyer to send to you photo-stats or write to the court where your case was heard.

On those court papers the outcome and final findings of the workers compensation hearing will state as to what your benefits are, and whether or not the case is closed or still pending.

On those court papers, your attorney of record should appear. If your attorney was the individual who no longer works for the firm that represented you, the firm is still your attorney and someone else would have to be assigned to your case. If the attorney listed has moved or is no longer your attorney, try the telephone book or get in touch with your clergy or the bar association for a reputable attorney to work with regarding your income.

Before you can proceed, get hold of all of your court papers and ALWAYS have a complete copy of any medical findings pertaining to your injury.

You need a new attorney and to complain to your state bar association.
