You may go to jail, and you may lose your license, but they won't be able to go into the court with hard evidence against you. You have the right to remain silent and you have the right not to incriminate yourself. I will never blow again. I don't need an excuse. So what if you go to jail and lose your license. If you fail the test that will happen anyway. It is harder for them if they don't have the evidence to find you guilty of DUI. Also how high the alcohol measures makes a difference in stuff later on down the road, more classes etc. If you want an excuse say an attorney on TV said to never do it and that you know your rights.

A little known fact is-you have the right to refuse the breathalyser and request a blood test instead. You have a greater chance of passing the blood test if either a) you just consumed more alcohol therefore the 'new' alcohol wouldn't register on the blood test as it hasn't passed into your blood stream yet. or b) if you stall long enough to sober up (eg asking for your lawyer to be present) your blood alcohol will be lower by the time you get the blood drawn.

I don't think there is a good excuse. In my state and in many others a refusal to blow results in an automatic revocation of your lisence even if you have not been drinking. So Just go ahead and blow, but you might want to request (demand) a blood test if you think you might be actually UNDER the legal level of your state. Blood tests are far more accurate.

There isn't one. You DO have the right to refuse to take the test, but here in our County - and the State, bye bye license for minimum one year in addition to anything else they might throw at you.
Best solution - DON'T DRINK AND DRIVE. Geez - where have you been the last 10 years? You can't get away with it anymore... and how would you feel if you killed someone? That's the worst puishment you could live with - and it would NEVER go away.

Tell the cop that you have a high stomach bacterial count and are just a naturally fermenting type of person and that if you blow into the machine, it will give a false reading and that is tantamount to making a false statement and you don't want to break the law. good luck with that!

pretend that they are trying to frame you by giving you a crack pipe, and say that you don't want to be framed so your not touching it. keep insisting that it's a crack pipe. keep this up for about 8 or so hours if need be, so your BAC level will go down, then be like "oh, yeah, now that im not drunk anymore, i see that it is just a breathalizer test. oops!" ha hah.
