It depends on the situation. With the information you have given, it is impossible to know who is at fault. Was there a traffic signal? If so, who had the green light? This could easily be settled by going through an insurance company. However, in this case, the insurance company will decide who is responsible for the accident and that person's insurance premiums will rise. He is required to give you his insurance information if you request it.

He probably does not want you to report it because he is uninsured. If he ran a red light, he's guilty as heck. If you ran the red light, you could be found to be at fault even though he hit you. If he's insured, and his carrier is GEIKO, your screwed. My wife was re-ended at a stop light and was pushed into another vehicle. My carrier is not GEIKO, but the other party's is...needless to say, we got billed. By the way, did I fail to mention that the woman the CAUSED the accident WORKS for the City of ABERDEEN, where the accident took place?? I have since changed insurance company's....I no longer use Safeco.

you usually have to notify police if damage is over a certain amount (varies from state to state, I think California is $500). You don't say where the man on the motorcycle was or what he was doing, so it's hard to say who is at fault. If you're at fault, you need to pay to fix his bike.

He is at fault for the loss-- he is taking advantage of your age. Report this to HIS Insurance co. They should pay to fix your car. If he keeps comming on too strong, enlist your parents to help you out. Don't pay for his damages, he caused the loss and is trying to pull one over on an inexperienced driver. Also, if you would rather not involve your parents, report it to your insurance company and then you can give him their info and tell him to call them, not you.
