I am curious. Does anyone know what the NSA wiretapping program allows the government to do that the FISA court does not?

Let me clarify because I might be missing something. What I am trying to understand is what does the government lose by going through the FISA court, especially since they can obtain a warrant after the fact from a FISA judge. What capability does the NSA program give them that FISA doesn't.

FISA court is supposed to approve wiretaps that need to be kept secret from the public. NSA program did not go to FISA court, hence is illegal and unconstitutional and must be done correclty from now on. Unless of course you think the pres gets to violate whatever laws he wants to.

The FISA court does not really "do" anything. It just rules on the legality of programs like the NSA wiretapping. Except, the NSA program was not submitted to the FISA court for review.
