I have a roommate who I would like to get a restraining order against who has been threatning me and to destroy my property but we live together and are both on the lease, how would a restraining order work? Would they make him leave?

can i get a restraining order for those threarts? How long would it stay in effect?

Yes, a restraining order will make him leave,. It is an order by a Judge, if he doesn't comply, he can be arrested. Restraining orders work both ways, he can't come into the home, regardless if his name is on the lease, but you, also, can't go near him. If you do, you violate the order. Go to your local court house, state your case and have him served at work. He may be able to retrive some belongings, depending which state you are in, but you can have the police present when this occurs. Restraining orders are only temporary, you will both need to be present in court for them to be permanent.

"They" won't make him leave, you have to once you get the court order. Are you planning on getting another roommate right away? Then a simple call to your landlord to ask nicely that one be dropped and the other added will fix that problem. Explain the situation, he or she should be fine with that if the rent is paid.

Restraining orders aren't the golden ticket everyone makes them out to be, the police can only be so many places at one time and cannot be there to enforce it repeatedly.

Get another roommate lined up, then go to court and tell the judge he is abusive and refusing to vacate the premises.

One of you would have to leave. The other would have to pay the full rent.
