Habeus Corpus usually names a Governmental body as defendant and pertains to prisoners who claim they are wrongly incarcerated, and probably wont work to get the child back. She should probably seek a highly competent lawyer who can sue the couply for custody. But if she has given the child up for adoption she probably wont win. If the child was taken by the state because she was an unfit parent then she may be able to get the child back by showing she has changed her ways. Best advice is to get a lawyer.

It really all depends on the law of the state or country you're in. There are so many factors here. Did she sign an agreement terminating her parental rights? Did a court enter an order terminating her rights? How long has it been... I can think of at least 5 more issues right off. If you are the adoptive parent seeking to keep the child, hire the best lawyer you can. Then accept the decision and if necessary allow visitation or give the child back. If you lose custody I think it's likely you knew this was not an air-tight adoption to begin with. This is so tough, but think of the child. Is it really best to drag this on and have the change in custody occur later? Is the birth mother that bad of a person? Closely examine, and separate your interests and personal feelings of love for the child from the child's actual best interests. All this is easier said than done, I know, but maybe a counselor can help you sort out what to do. In the end, this case clearly requires both legal and counseling help.

re post, if necessary more than once, saying you are in the Philippines. You might get something of a hint or direction if you get an answer from a Philippine lawyer social worker or adoption agency official. You will have to make calls and meet with people to get any kind of definitive advice of course.

In the UK, there are only two ways to loose Parental Responsibility, one is death the other is Adoption. So if this couple have legally adopted the child, then the birth mother has no legal rights to the child.

If she gave her child up for adoption, then she probably doesn't have much of a case.
