Because Limewire itself is a software client, and not illegal. They are in fact a legal business, offering a way for people to share files. There is nothing illegal about that. What IS illegal, is to upload or make available copyrighted media, and/or to download copyrighted material.
The uploading and downloading is where the secret is. As long as they have a disclaimer that notifies YOU that transferring copyrighted material is not allowed by law, AND that they are NOT held accountable for your actions, they are in the clear!
I am not a legal professional, and I might have worded this wrong, but I remember reading an article explaining this when Napster went to court.
EDITED TO ADD: ok, I did a little more research, and read at "How Stuff Works" that Limewire is actually one of several software clients for a technology called Gnutella. There are more than a dozen free software downloads that do the same thing as Limewire, but I'm guessing Limewire is the most popular in features.
Apparently, part of the legal process here, is a loop hole in the law that allows "FRIENDS" to share copyrighted material. Napster had a central database that held the information of millions of songs, but not the songs themselves, as those are available on YOUR computer once you initiate a P2P software.
The Gnutella concept changes the way queries are executed, and does not require any single "server" (YOU) to have a list of everyone elses music. This approach brings the "friends sharing a file or two with friends" a little more into focus.
It is STILL illegal to share copyrighted media on any of the Gnutella type systems though, so if you get caught by the music industry, you WILL pay the piper!

Subscription music services are cheap, legal, and virus-free.

Why ban p2p software because a minority uses it illegaly.
I do not want a situation whereby the minority dictates the rules for the majority.
