I've lost my job and can't afford the house payments. I need to know what my options are. It's a small community and selling the house may take a long time.

If it wasn't included, you may be out of luck. Depending on where you file, you included, but declared as homestead, which allows you to keep it. I suggest you go back to your attorney.

When I filed Chap 7 back in '93, I tried to reaffirm one of my credit cards. They said that I should leave it out of the BK if I wanted to keep it. Still wary, I included it. The exact same day I filed, they canceled my account as a BK risk. If I have followed their "advice" I would still have been liable for the debt.

I say this because I wonder why in the world you would not have secured you home. You really need to talk with your attorney.

You need the advice of your attorney, but frankly, usually when people declare bankruptcy, ALL debt is added into the mix. Your house is probably your biggest payment so I can't imagine you not including that when you filed.

If you didn't include it in the bankruptcy, then no you can't.

If the case hasn't concluded yet, then you may talk to your attorney and see if you can still add it, but my guess is no.
