No, it's not illegal. In most cases, they are required to give it back to the student to take home. Children do not need to have cell phones or mp3 players in school, anyway. Those are part of the cause of American students falling farther behind in intelligence compared to the rest of the world.

It depends on the school rules, the board of education, etc. where you live and the particular school you go to. As a teacher may I suggest that am mp3 player in class is not necessary to your education. As for your cell phone, tell your friends NEVER to call you during class hours, set your phone on vibrate and if it goes off, you know it is a family member and an emergency. Ask permission to leave the class for a moment to take the call. However, if the school you go to says leave it at the door, do so. Emergency calls can go through the main office.

What's disturbing about your question is not so much whether or not things can be confiscated from you the student but that you are more concerned about losing your "toys" than you are in getting an education.
Your question tells me that you are NOT paying attention in school, not getting good grades, probably failing many of your subjects because you'd rather be text-messaging and sitting around with an mp3 player stuck in your ear.

If the school has a specific policy on electronic devices (nearly all do) then they are within their rights to take your items. If you continue to willfully violate school policy, that is a far more serious offense. I suspect that a school employee would only take an item from you if it was in use. It would be extra work for the employee to "deal with you"

No it's not illegal especially if it's interrupting the teacher,or disrupting the class. But they can either hand it back to you or they can turn the stuff in to the attendace office where you can get it later.

No, it's not illegal for them to confiscate them. But it is illegal for them not to either return them to you at the end of the year or allow your parent to claim them for you.
This is SCHOOL not summer camp. You're there for an EDUCATION not social hour!

School staff can take ANYTHING away from you. You are on school property, anything can be taken.
Not only that, they also have the right to search you, or your property at any time.
