I did not give her permission to have my daughter posted on the internet ( she is 3yrs old). I have legal custody of my daughter, she says in her myspace that she will be my daughters future stepmom.

I have a MySpace account and I have a daughter and a step-son. Just out of respect for my husband's ex-wife, I do not post any pictures of my step-son because I believe that is crossing the line. I love my step-son as if he were of my own flesh and blood and I would love nothing more than to show him off to the world but by the same token, I have to use "common sense".

This is a very delicate matter and should be treated as such. I say that more than likely, you can take legal action. It would probably be a different story if your daughter appeared on your ex's MySpace account.

You ex's gf should have used better judgment and should have taken everything into consideration before posting those pictures. True, you can contact MySpace and have them delete the photo's but in turn, you ex bf will probably post them on his MySpace if he has an account just to spite you. Be prepared.

Yes, You have legal rights. You can take her to court and have a court order to say she can not have the picture on there. Now if the site is your ex's and it is his daughter he may have the right to place her pic there depending on his rights. If you have sole custody then no you have all the rights. I had sole custody and my ex father in law wrote a book and published my sons picture. I had my attorney send a letter to the publisher and the recalled all the books. Boy was he pissed. It is your choice as to where your child's picture is posted.
The only bad thing is you will have to go to court likely. You might want to try contacting Myspace and sending them a copy of your custody papers with a letter indicating you are intending to sue her. They may make her remove it just to avoid legal issues.

She's possibly doing this because she knows it will upset you. And since you have custody of your daughter, don't let them trick you into reacting and doing something that could make you lose what you do have. Putting that kind of info on the web shows that she is truly immature, you need to be the bigger person and do nothing. I know that it's hard; like ignoring the recess bully. Once she know she has no power over you/emotions it will die down. Unless she's that immature; and if that's the case, there relationship doesn't have that strong of a chance working out anyways.

as long as its a clean picture, id be willing to bet that a judge would laugh his azz off at u, UR BEING PETTY , ur not mad that she has the picture on her myspace UR MAD BECAUSE THIS IS UR X's GF. lol get real, stop actting like ur a saint and ur fearing for her life.. or something lol.. UR JEALOUS and ur pissed cause shes saying shes ur daughters future step mom and that infuriates u, u know damn well that if ur best friend put a pic of u and ur daughter on her webpage, or someone in ur family did it.. UD HAVE NO PROBLEM WITH IT.. but its because she is doing it that u have the problem.. Please go to court.. so the judge can laugh at u .. and u can look like a complete idiot infront of everyone.. and for all of those answers that say , with out ur permission.. GUESS WHAT her father has just as much rights to give HIS permission to BOTH of your's daughter as u do.. and as long as he gave HIS permission, then thats all there is to it.. grow up , pick and choose ur battles wisely.. ur being so petty..

Come on....you sure a Petty, go find something else to do than checking out your ex's girlfriend myspace page. Go find a new boyfriend, go out more, really will make your mind clear up a little. Good luck!! Don't become in a crazy phsyco lady!! you are better than that.

It is illegal for people to use pictures of your children in any context, for any reason, without your permission. Simply contact Myspace and let them know a user us doing this and remind them that it is illegal for that user to do so AND illegal for them to let them. They will delete the user's account immediately.

If they go so far as to remake the website and put the picture up again, you can contact a lawyer and serve them with a cease and desist letter. If they ignore it, file a complaint with the cops. Being dragged off in cuffs for violating a state's anti-stalking law tends to get the attention of even the biggest assholes.

YES you can , its your child and only you can do that, if she was already married to your ex then she could post a family pic ,, see a lawyer, and report it to myspace,, with all they have been going thru in the news, im sure they will pull her page

well while it is bad taste on her part, i dont believe you have any legal standing on the posting of the picture, but if it does come to a custody case having that posted may help you out in the long run. and if your really pissed about it, post her picture on myspace and label it "satans personal b#tch" j/k, good luck

From what you have said, it appears the father has consented.

I really don't think there is anything you can do.

I'm more concerned about why this would bother you so much. And why are you even looking at her myspace page? Concentrate on your life, not theirs.

If you didnt give your ex bfs girlfriend permission to have your daughter on there. Theres no to take it off yourself unless you know her id and password. But you can report it to myspace and have give them send your ex bfs girlfriend a warning to please take it off.
