This is a really good question, and judging from the answers by the rest of you, I feel confident in my response.
What I want to know is how the hell someone can support abortion or be "pro choice", and yet say that a person needs to be charged with two counts of murder if he kills a pregnant woman? How can you justify that?
Its either a life or it isn't...there is no gray area! If you are pro choice and feel that charging a person with a 2nd count of muder in the death of an unborn child is the correct course of action, then I'm sorry, but you area Major Leauge HYPOCRITE.
And I don't want to hear any bull that there is a diffrence because one baby is wanted, but the other is not. That is not an argument.

The driver should be charged with 2 counts of murder. Especially if the woman is in her 2 trimester.The fact being that he killed the mother which prevented the child from even being born.And if the person is stupid enough to drink and drive it's the drivers own fault, and he should be punished accordingly

Should he be charged with two? YES
Neither of them intentionally, however, he will be charged with negligent homicide by use of a motor vehicle.
My theory on that is that if the drunk driver was stupid enough to get behind the wheel and kill one, then he is stupid enough to kill another, it is just like having a passenger sitting in the seat next to you or walking next to you across the cross-walk.

Where I used to live a deputy Sheriff speeding on a rain slicked road in his patrol car (not responding to a call as the investigation proved) ran a pregnant young woman off the road and into a tree killing her and her baby. Last I heard on that, he was still out giving tickets. Guess it depends which side of the law you are on as to what you can get away with.

When Lacy Peterson was killed by her husband I believe he was brought up on 2 counts of first degree murder. After that case Bush signed into law "Connor's Law" which allows for bringing charges against someone for murdering an unborn baby.

I don't know if it's changed or not, but a few years ago, a baby had to have drawn breath outside the womb to be considered legally alive, and therefore capable of being killed. (at least in certain states)
As to what should be... I really don't know. I've never been able to make up my mind on subjects like this.

The driver is liable to two counts of homicide because his negligence resulted to the death of two persons as provided for in the Penal Law.

He should definitely be charged with 2 murders!! Drunk driving is never going away until some serious punishment is dealt out with the very first offense.
