You have me a little bit confused but i will try to answer as best i can. First of all the only reason for a side pot in no limit Texas hold'em is when one person is all in and the others in the hand who have more chips bet into the side pot. At the end of the hand the two players who had more chips then the short stack show their hands and the best hand of the two takes the side pot, and then the person who had less money than the other two can take the main pot if he or she has the best hand. As for someone folding (mucking) their hand,it is dead if they fold the hand, even if she had you beat and she folded her hand it should be a dead hand. I myself deal in Vegas and play friendly poker at my house once a week and i always tell everyone at the table before we begin a list of rules and i tell them all decision's made by me are final, in other words i am the tournament director.

In general, when someone folds they are out of the hand and forfeit all rights to any and all parts of the pot.

With that said, since "High Hand" is a house rule not an official Poker rule its pretty much whatever everyone agrees on and things like this should always be decided before you deal.

if your flush beat out all the other hands including your original hand then yes it counts say you have 3 kings all diamonds and on the river you get your fifth diamond no matter what that flush beats all and if she folded her hand before or after the river you win it all no matter what her cards are void
