The farmer was found and was present a the scene,two other vehicles were involed in accidents with his cows the very same evening.The farmer is insured,however consul has advised that the law protects the farmer,sayig that he need only state that he was not neglegent and he is protected by the law

I am now completely disabled as a result of this accident and really in trouble financially,Ireally need some answers

I was working as a sub contractor for a dilivery company,I borrowed a truck from my supervisor and his insurance had lapsed

You can usually only get damages from him if he knew the cows were getting out onto the road, and did nothing about it. If you can find proof that he has had several instances of this, you may be able to prove negligence. Your damages would still be offset by your own negligence.

The law generally recognizes that livestock will stray, and even the most diligent farmer can have a fence knocked down from time to time. The driver is usually presumed to be the more negligent party, since a cow on the road is pretty big and visible.

If the insurance lapsed on the vehicle you were driving, you can probably still get medical bills paid under your own car insurance PIP policy (if you purchased this). There may be an exclusion under that policy for accidents while you were working though.
