I suggest that you, and the other families involved, write a letter to ALL of your local law firms. Almost all attorneys donate some of their time to take on particular cases at no cost. Also, contact the law schools in your state and ask if you can apply for assistance through their "Clinical" programs. The students who take on such cases are supervised by experienced faculty members through all steps of the case. I can almost guarantee that this case WILL be appealed if you win. It can indeed be costly, but please don't allow that to deter you, or your child(ren). Contact every attorney that you can! I suggest you start with family advocates, civil rights attorneys, and other tort attorneys. However, all of them are indeed educated in torts and are capable of taking your case if they are a member of the American Bar Association. You may contact your state Bar Association and ask for their particular recommendations as well.

While I don't condone what the teacher is accused of doing, I also know that children can push buttons. Are you going to tell me that your child was completely innocent of anything? Did your child do any sort of antagonizing or rude behavior that might have pushed the teacher to the brink? And what about the other "at least 2" students? Are they on the Top 10 Detention holders? One would have to ask these questions.
I was a child that was disrespectful in school, and was rude to my teachers and other authority figures. You want to know the best thing that my mother did for me? She told my 6th grade teacher - right in front of me - that he had the right to "cuff" me if I acted up in class.
Needless to say, I was very good that year.
I think that while assaulting students is uncalled for, I do think that if teachers had a little more backing from the parents, they wouldn't have such issue with the children.
The most popular defense for kids made by parents: "Not my kid!" If not yours, then whose is it??

ANY lawyer will take ANY case for the right price. Lawyers are about half a step up from cockroaches on the decency ladder.
They're all scumbags who will do anything for a buck, or some free publicity on TV or in print.

Why won't they take your case? i ask your self! possibly it has some thing to do with the actuality which you (via sending your toddler to a publicly-funded college) quit all 'parental rights' to the school for those hours, in accordance to the concepts of "in loco parentis"....if it would be criminal (whether distasteful) which you will place him in a closet, it rather is criminal for THEM to accomplish that....in spite of the undeniable fact that I rather suspect there is greater to this tale than you have shared!

Sounds like you don't disiplin your son enough. Would you like to borrow my paddle? How many times did he ignore the teacher before he did that?
edit: Oh yeah, you definately deserve money for such a heartwrenching situation. I'm sure he damaged your kid so much he can barely walk, right? How long has your kid been in a hospital due to the extensive injuries? SUE SUE SUE SUE SUE

The ACLU can help you find a lawyer to help you with this case. Whether you agree with their politics or not, this is just the type of case that many ACLU lawyers like to handle.
