You might/might not get caught, change where you save your downloads and dont download 24/7, just one every few days.

Technically, I think it's illegal both to share and to receive (download) files without the owner's permission (but this might vary from country to country). So for example, download of music is about as bad as sharing it.
Note, however, that if the content you are sharing (or downloading) is not copywritten (such as a home-made video, or a book that you wrote), then neither sharing nor downloading it is illegal.

If you dont have files uploaded, youll stay safe. Its like drugs, they go for the dealers and not users.

filesharing isnt illegal sharing copywrited material is, so if yopu dont share there is no crime.
