They have been on the family law panel together for four years and the judge keeps letting the evidence get pushed aside. there is a three year old who is being abused in this case and I need to know if this is ethical. The child has explained in detail about the abuse, DHS has substantiated the abuse, then father had the ruling overturned on technicality. There was a letter he received three days late. Father still has access to child, child is scared to death of the man and insists that he(father) will make the mother stop loving the boy or disappear. Does anyone have suggestions?

Have the attorney representing the child's case appeal the decision.

File a complaint with the chief judge if they think the system isn't working. Or file a complaint with the bar ethics committed if they think there's judicial bias.

i think the question that you need to be asking instead is whether the judge should have to recuse himself because of a conflict of interest.
