i am currently still married to my husband legally but we are planning a divorce.My husband and His landloard which is his uncle are trying to kick me out of the apt.But i have nowhere i can go.I have not resided there in the past 4 months but had to return recently.My husband has had to go to court for domestic violence with me so i had no choice but to leave for my own pensonal safety.There is no official lease.Can i still legally live there untill i can get back on my feet?

The best thing for you is to remove yourself from this environment maybe a woman's group or church can find a place. I know it is not what you want to here but it is the answer.

I would recommend that you call local law enforcement and ask if there is a special shelter in your area for domestic abuse victims. They will usually let you stay in the facility until you have enough money to put the money down for your own apartment. Other than that you may also want to check with some of the social service agencies in your area to determine if there are any places you can go associated with churches in your area. There are lots of alternatives that would not put you in harm's way. Good luck.

If there is no lease with YOUR name on it, then it'll be a tough battle to stay at your current residence.

However, sometimes there's certain circumstances where a judge would merit you to legally stay at a residence. However, this does involve going to court if you are indeed kicked out.

Before things get worse, and you're also getting a divorce already, I'd consult with a lawyer. Better to be safe than sorry.
