The specifics of music and electronic intellectual property piracy versus legal use is being fought in courts worldwide. The basic answer is that piracy is when music or intellectual property is transfered between two parties without the permission of or compensation for the creator of said property. Many of the questions are in what constitutes fair personal use. Burning a CD to listen to in a car? Giving a CD to a friend? Giving a CD to 10, 100, 1000 friends?

Neither is one is legal. If you are distributing or obtaining copyrighted music without permission from the company it is technically illegal sharing or otherwise. Ethically, however that's up to you to make the call.
It is perfectly legal if you created and composed the music yourself and/or have permission from the group or artist to download and distribute it for free.

I believe that piracy is anything that would violate the software license.
It's my understanding that for CD's, you can basically do anything for your personal use, but it's illegal to buy music and give (or sell) that music to others.
