What is the policy in schools about this? Isn't this assault? Can't the teacher file charges against the student whether the school does anything or not?

does anyone know if there are statistics kept on this type of assault?

Unfortunately, I work at a school where this type of thing happens rather frequently.

Teachers do have rights. If the teacher is knocked down, he/she can call the police and press charges against the child, regardless of whether the school does anything or not.

Also, the teacher should immediately contact his/her union representative, and fill out an incident report. The only official record of these incidents are the incident reports. Too often, teachers don't file them. Then when the statistics on school safety are compiled, it's like the incident never happened.

If the teacher files the report, the school should perform an investigation. In New York City, I THINK our contract states that if a teacher is assaulted by a student, that teacher has the right to transfer to another school, or have the student transferred to another school. Personally, with all the assaults I've seen, I've never heard of either thing happening. The teacher really needs to involve the union rep and press the issue.

According to the NYC citywide discipline policy, if a student assaults a teacher it is a mandatory superintendent's suspension. Unfortunately, this policy is often not enforced.

My best advice for any teacher who is pushed or struck or knocked down is STAY DOWN. You are entitled to compensation for on-the-job injuries. If a student so much as taps me, I have three chiropractors who will testify that my back has been injured so badly I cannot teach anymore.

I was hit on the face by a student and I filed assault charges against the wishes of our administrator.
Check your school district policy.Our policy states if a school employee is assaulted they can take off from work as long as necessary without the days being docked from your sick or personal days

It sounds like assault and I suppose the teacher could file charges if they wanted. They could probably also report it to their union and deal with it through that means.

They could press charges and sue... But most won't because they are afraid of the reaction and backlash.
