There's a legal definition of rape and a common definition of rape.
In the legal sense, the definition involves human sexual behavior.
In common usage, it could very well involve an animal. Some people might even say "I was 'raped' by the loan shark." even though it didn't involve sexual behavior at all. It is used more in the sense of "violated."

Legal Definition (Sexual Offences Act s1 2003)
You need to prove the following if someone is guilty of rape:-
THE ACT(ACTUS REUS)
- the penetration of another by his penis (note women can not rape)
- the victim's lack of consent
MENS REA(The mental element)
- the intention to penetrate the other
- absence of reasonable belief with regard to the victim's consent
- But rape has to be by a human being who has a penis
- I think it is a good question

The same reason why killing of an animal is never termed as murder ( even when you are not even going to eat what you killed ) In both cases , animal lovers will be concerned a lot and any law of the land which prohibits cruelty to animals should be applicable.

If the animal is attractive then I think the person who commits the act is guilty of rape otherwise it should be treated as animal cruelty.

Beastiality holds a different sentancing that usually has something to do with psychological treatment.
Rape is just jail time and abuse by inmates.

In human rape there could be two charges. Sexual assault and killing. But in animal rape there could be three. Rape, Killing and Eating.
