No its a stalemate (draw). The only way to determinate a winner is to start over again..

In chess, if a player is unable to make a move, the game is a stalemate (a draw).
In checkers, if a player is unable to make a move (either because all of his pieces have been jumped off the board or because they are stuck behind several other pieces), he loses.

That situation would cause a stalemate. If you want to find the winner, start a new game and see who the winner is.
