How do I evict a tenant who has trashed the premises? e.g. junk cars, garbage, 16" high lawns, oil soaked soil, etc.. He has paid the rent so far, but just gave me notice. His rent is due 8-21-2006, but I doubt I'll see it.

You can evict a tenant for trashing the property. Stop by the country courthouse at the clerk's office. They'll advise you on the process.

Basically you'll have to send him written notice to clean up the property or vacate the premesis, usually within 30 days if rents are current or 3 days if either rents are not paid or a serious public health or safety situation exists. The times vary by jursidiction but the clerk's office can advise you on that.

If you're lucky, they'll pull up and move. Use the security deposit to clean the place up and send them the balance or a bill for the unpaid damages within 30 days just as you would with a normal move-out.

If they don't vacate, file the formal eviction proceeding at the court. Again, the clerk's office will advise you on how to proceed.

You said that he "just gave me notice". What type of notice did he give you?
