How can a 16 yr. old get emancipated in new york?
need immediate info on Emancipation from a parent. I am 16 years old residing in Manhattan, Ny. I would like to become emancipated from my mom, because there are a lot of family issues, and I feel that I can be on my own. I would like to get a job, still go to school, and there would be somewhere for me to stay.
Me and my mom dont get along most of the time. She doesn't let me spend time with my father. Sometimes I only spend 3 hrs with him a week. He just opened me up a bank account, she restricted my access to it. We also have gotten into a physical fight, and I called acs.
I would like to know what I have to do to become Emancipated? Please help

Go ask a lawyer. I was emancipated because my mom died when I was 9 and my dad was a drunk. I moved from foster home to foster home til I was 16. Then I got pregnant (I don't recommend this) so the courts emancipated me.

Emancipation in NY would require that you find a place to live, a job to support yourself and not depend on any adult for your support.
Here is a great description of it:
The term emancipation applies to youth over the age of 16 and under 18 who are:
(1) living separate and apart from their parents;
(2) not receiving any financial support from them (except by court order or benefits to which they are entitled, i.e. Social Security);
(3) living beyond the parent's custody and control; and,
(4) not in foster care.
Emancipation involves the renunciation of the legal obligations of a parent and the surrender of parental rights over the child. It may occur when a parent is unwilling or unable to meet his/her obligations to one's child or when a child refuses to comply with the reasonable rules of a parent and leaves home.
In New York State, there is no Emancipation Statute or court proceeding in which an Order of Emancipation can be obtained. In New York, the status of a youth as an Emancipated Minor depends on the facts.

Well I would really hope you and your mom could work the problems out. I have no advice on how to become emancipated but if your going to school I think that would be a great place to get the answer at. I hope and hope your mom will realize how she has wronged you and fix it maybe there is something you need to tell her that you have not. Be wise my friend and the world is yours for the taking.

That is not easy for a 16-year-old to do. Maybe live with your father until you are 18? Then you can get a job and a place of your own. Good luck and God be with you.
Edit: I just thought of something. When you turn 18, join the Navy! They will take good care of you. For some people, the Navy is their home and family.

Like honestly, I was in a situation worse than that. My mother told me my father didn't want to see me, yet she had a restraining order against him so he couldn't. She threw out my bed when I was 16 and I wasn't even allowed to sleep on the couch. I had to sleep on the floor while my brother got a brand new futon and bedroom furniture. And that's no even the half. I worked hard in high school and applied to nothing but out-of-state/ out-of-city universities. I was a dancer to make sure that I did not go back home. My suggestion to you is buckle down in school and work your behind off to be able to go away to college. It helps you stand on your own two feet in the real world and provides and education necessary for today's volatile market. Apply for FAFSA get an on/off campus job and go from there. Just stick it out, there are homeless children in this world, you can survive your situation. Oh, by the way I have two degrees, one in African-American Studies and one in Communications, Media, Arts, and Theatre. I am married going on two years and have a beautiful daughter. You can live a great life if you're willing to have patience and work hard.

You only have two more years until you turn 18. I would recommend that you wait.
After high school, go to an out of state college and live on campus.
