It actually depends on a few things. Marital property, if there is an agreement on who is taking the children, and how well you and your soon to be ex get along. If it's argument after argument, this divorce can last up to two years. Easy rule of thumb is you have to give a little to get a little. If you want it easy, make your spouse an offer he/she can't refuse. Nine times out of ten, they'll go for the immediate settlement if it's pretty enough and not even think of the long term. You have to choose your battles carefully and keep in mind that when an ex says they want to do this peacefully, it often starts out that way, and somehow during the midst of it, the gloves come off. Be prepared for anything, because anything can happen and most likely will if you aren't expecting it. Just promise yourself that whatever you choose to do, you and your spouse make the children the first priority. They are going to be the ones who have to deal with the outcome, not the two of you. not sure what nys is but divorce is always complicated.. and it's hard on kids..
