My tenant (who was also my friend) paid his rent of $1200 by a personal cheque. For some reason, I didnt cash it for 40 days, now when I deposited the cheque it bounced back saying that the cheque is cancelled.
At the same time, my friend has also vacated my apartment 10 days back and left to out-of state and has so far not informed me of his new residence. He is not answering my calls either.
I want to go to the small claims court for the cheque fraud but I dont know his latest address to summon him to the court. I didnt have any formal lease aggrement with him, so I dont know his ssn either. Can I ask his Bank to give me his latest address or ssn? please advice how to proceed further.

They cannot give you his social security number - that would be illegal. The bank cannot give out any personal information on any of their customers.

Check with the post office - see if he has a forwarding address on file. That would be the first place I would start.

Your friend may have planned on this if he knew you weren't real good about depositing checks. Since the check bounced, which it shouldnt' have at 40 days, he is in arrears for the rent.

His mail has to be forwarded somewhere. Unless I understand you that he literally skipped out on you and all his other creditors. Send a registered/certified letter through the USPS. This is your 1st step in proving your legal postion. Contact a lawyer - since he is now out-of-state, small claims court won't help much.

Hope you learned your lesson. Arrange to have rent checks directly deposited into an account - most people can arrange this through their own bank - you'll know much faster if the check doesn't go through, before they move...

It sounds like he/she planned that out well! Why did it take you 40 days to cash the cheque? They probably cancelled the cheque and used that money to leave the state.

Hmmm ... do any of your other friends know where he/she moved to? Perhaps when you locate your ex-tenant, small claims court could be an idea.

Take it to the coumty attornies office or whom ever handles bad checks in your area.
