I think we are confusing the Jolly Roger or Skull and Crossbones Pirate flag and the international symbol for danger/deadly, and about six or seven other warnings. It is not illegal to fly the skull and cross bones on high seas as it is a common flag for ships quarrantined for biological pathogens. I wouldn't do it since it would probably attract a lot of unwanted attention. Go down to the Florida Keys and at certain times of the year, a 100 vessels sporting the flag are not uncommon. A minefield in any country is commonly posted with the skull and crossbone as any container with a poison. Today, most real pirates aren't flying any flags but the AK's sure are a lot more frightening. By the way, if you research Pirate Flags, every ship had its own design, the commonly associated "JR" was a design flown by a pirate called Edward England. But every other pirate had his own.
