Is is the total household income, the income of the parent, the environment or area that they live in, the intellegence of the parent, the school's overall rating by the board of education, or something else? My child's father and I live two hours away from one another and I'm scared that he will win the right to put her in a school of his choice. We both have shared legal and physical custody, and both of us have been following all of the courts rules, but I'm still worried that he will get his way and make her go to a school in his neighborhood. If he does, she will only get to see her step brother and me every other weekend untill she is grown. Some background on us....I have a associates degree in child education, he is a forman for a sub contracting company for Delaware county, I earn less income than he does, he is planning on moving in with a guy friend and that person's kid. I own my home in the country. Please, only advise if you know the answer for sure. Thank you so much.

This is something that you can take up with the court, as part of the custody arrangements.

The court will act in the best interests of the child. The factors vary by state, but generally center around whichever arrangement is going to provide the best education, the best social environment, and most closely comply with the remainder of the custody order.

It's whichever way the wind is blowing across the Judge's you know what, dear--that's the factor that decides who does what where and with whom.
So wear a short skirt, a tight sweater and cry.

it should be the school which is most suitabe for the child i.e class sizes, friends, facilities etc.
