Most states that I know if the age is 12, but more important, you should hire a Guardian Ad Litem, which is like a lawyer just for the child.
They will talk to both parents, check out the environments and attitudes of both parents, discuss things with the child, and tend to have more weight in court as to what the child wants than just the child's word itself.

depends on where you live you have to call the courts and ask some places are 12 others 16 17

In most states the age is twelve, but I did have a friend who's eihgt year old child was asked in court which parent he preferred to live with.

I know that in the end her thriteen year did not have to go to visitation, but the eight year old did. Good Luck!

In the state of Texas it is 12 years old, but it ain't that simple.I was told you have to get an attorney to start the process $$$$$. And that it still would be up to the judge not only the child and the circumstances. What ever your situation, ALWAYS keep in touch with your child and do as much for him or her as possible.They will understand as they get older. Good Luck.
