got bit in the face between the eyes,and owner didnt have insurance,but the owner of the apartment where he lived did, i found that out myself,there insurance company will only pay up to 5000 dollars.I want them to settle with me so i can go after the dogs owner.im looking at close to 7000 dollars in plastic surgery costs.

You get a lawyer. State laws vary considerably regarding dog-bites. The owner of the dog may be liable but so may the landlord. Just because the insurance co. makes a low offer doesn't mean you have to take it -- in fact, if you do you may unintentionally release the only deep pocket available to pay your damages. With 7k in plastic surgey you have a major claim. If you don't retain a lawyer, you are a fool.

Sue the insurance company -- it'll take a little time . . . but, they'll most likely settle . . . it's usually a smart decision to make.

Why do you have to wait until the insurance company settles to sue the dog owner? The fault lies with the owner of the animal, not the owner of the property -- right?

You'd be lucky to get the $5000. It wasn't the building owner's fault that you got bit and you would probably lose in court. $5000 is a nuisance settlement that they are willing to pay just to make you go away.

unless the owner of the apartment had prior knowledge of his tenant dog's tenancy to bite then the insurance of the landlord will not settle since the landlord will have little liability toward this claim, unless as I said before the landlord had prior notice of his tenant's dog tenancy to bite, they will not settle and you may not win against the landlord
